Can You Get Phentermine Online in Florida? What the Law Says

Updated October 31, 2026 · 6 min read

Yes. Licensed providers can prescribe phentermine, an appetite suppressant, by telehealth in Florida. Florida's telehealth limit on controlled substances covers only Schedule II, and phentermine is Schedule IV. A federal exception lets the first visit be online through December 31, 2026. At Padgett, a telehealth visit also needs a Florida ID and a picture of a recent blood pressure reading.

What does Florida law say about prescribing phentermine by telehealth?

Florida allows it. The state's telehealth law is section 456.47 of the Florida Statutes. It bars telehealth prescribing of Schedule II controlled substances, with four exceptions: treating a psychiatric disorder, a hospital inpatient, a hospice patient or a nursing home resident. Phentermine is not a Schedule II drug, so that limit does not apply to it.

Older information may say otherwise. Until July 1, 2022, the same law blocked telehealth prescribing of any controlled substance outside those four exceptions. A 2022 law, chapter 2022-26, narrowed the limit to Schedule II only, so anything written before that change may be out of date.

The law also sets the bar for the visit itself. A telehealth provider has to meet the same standard of care as a provider who sees patients in person in Florida, and has to document the visit to the same standard as an in-person one. Is phentermine a controlled substance?

Yes. Phentermine, an FDA-approved generic appetite suppressant, is a Schedule IV controlled substance. Its FDA label says so, and Florida lists it in Schedule IV in section 893.03. Florida describes Schedule IV drugs as having a low potential for abuse compared with Schedule III and an accepted medical use, and says abuse may lead to limited physical or psychological dependence. Schedule II is for drugs with a high potential for abuse, such as oxycodone, fentanyl and amphetamine.

Phentermine is still controlled for a reason. Its label explains that it is related to amphetamine, both in its chemistry and in how it works, and it tells prescribers to keep the possibility of abuse in mind. Florida law (s. 893.055, Florida Statutes) also has prescribers check E-FORCSE, the state's prescription drug monitoring program, before prescribing many controlled substances. For patients 16 and older, that includes phentermine.

Do federal rules allow online phentermine prescriptions too?

Yes, for now. Under the federal Ryan Haight Act, a prescriber generally has to see a patient in person at least once before prescribing a controlled substance by telemedicine. The Drug Enforcement Administration (DEA) and the U.S. Department of Health and Human Services have extended a temporary exception through December 31, 2026. Until then, a DEA-registered prescriber may prescribe Schedule II to V medications by telemedicine without that first in-person visit. Federal conditions still apply, including that each prescription is for a legitimate medical purpose.

The same federal notice explains that once a prescriber has evaluated you in person, the in-person requirement no longer applies between you and that prescriber. Temporary rules can change. If this one ends without a replacement, federal law would generally call for an in-person visit before a first telemedicine prescription. You can also see the provider in person at the Ocala clinic.

What do you need for a telehealth phentermine visit at Padgett?

You need three things. First, you must be physically in Florida at the time of the visit. Second, you need a valid Florida driver's license or state ID. Third, you need a picture of a recent blood pressure reading, sent before the visit. A reading from a home monitor or a pharmacy blood pressure machine works. If you'll be out of state that day, pick a day when you're back. Without a Florida ID, your phentermine visit is in person at the clinic, 200 SW 8th St., Suite A, in Ocala.

Why the blood pressure picture? Phentermine's label lists raised blood pressure among its possible side effects. It tells prescribers to use caution even with mild high blood pressure, and it lists uncontrolled high blood pressure among the reasons not to take it. On a telehealth visit, no one can take a reading in the room, so a recent picture gives your provider the number. Phentermine side effects, and why your blood pressure is checked goes deeper.

What happens at a telehealth phentermine visit?

Your visit is with Sarah Weir, APRN, an advanced practice registered nurse. She goes over your health history, the medications you take and your blood pressure reading. Phentermine's FDA label covers people with a starting body mass index (BMI) of 30 or more, or 27 or more with another risk factor, such as controlled high blood pressure, diabetes or high cholesterol. You can check your number first with the BMI calculator.

The label also lists reasons not to take phentermine. They include a history of heart disease, stroke, heart rhythm problems or heart failure, an overactive thyroid, glaucoma, an agitated state, a history of drug abuse, and pregnancy or nursing. Taking a monoamine oxidase inhibitor (MAOI), now or in the past 14 days, is another. No prescription is promised in advance. Your provider decides whether phentermine is safe for you, and sometimes the answer is no.

What's included, and how do refills work?

Your first month at Padgett is $196, or $127.40 when you book online with a card on file (35% off). That covers the visit with the provider, your first month of phentermine and a B12 injection, and it is for new patients only. Monthly refills are $166, including the monthly visit, the medication and a B12 injection. Blood pressure is checked at the visits. Nothing is charged when you book, and the clinic holds your visit with a card on file. You can book without a card, but the appointment isn't confirmed until staff reach you by phone. There's no contract. The only other charge is a $50 no-show fee. It applies if you don't show, or don't cancel or reschedule at least 24 hours before the appointment, and it can be applied to your next visit.

The label describes phentermine as short-term help, for a few weeks, alongside exercise, behavior change and a reduced-calorie diet. How long you stay on it is up to your provider, and how long you can take phentermine explains more.

Is it safe to buy phentermine online without a prescription?

No. Phentermine is a prescription-only controlled substance, and federal law bars dispensing it over the internet without a valid prescription. A website that sells it without a visit and a prescription is a warning sign, not a shortcut. The FDA warns that unsafe online pharmacies often sell prescription drugs without requiring a prescription. What they ship could be fake, expired, the wrong ingredient or the wrong strength.

With phentermine, the visit is the safety check. A site that never asks about your heart, your blood pressure or your other medications has skipped the step that protects you.

How can you tell a legitimate online phentermine provider?

Check three things. First, the prescriber should hold a Florida license, or a Florida telehealth registration if licensed in another state. You can look up either one on the Florida Department of Health's license verification portal. Second, there should be a real evaluation that asks about your health history, medications and blood pressure. Third, the medication should come with a prescription, never as a no-questions-asked purchase.

If a pharmacy fills your prescription, check it against the FDA's signs of a safe online pharmacy. A safe one always requires a prescription, has a U.S. address and phone number, and has a licensed pharmacist to answer questions. It is also licensed by a state board of pharmacy. The FDA's BeSafeRx page helps you look up a state-licensed pharmacy and report a site you think is selling medicine illegally. Frequently asked questions

Can I get phentermine by telehealth if I'm visiting Florida from another state?

Only with a valid Florida driver's license or state ID. Telehealth also requires being physically in Florida during the visit and sending a picture of a recent blood pressure reading first. Without a Florida ID, your phentermine visit is in person at the Ocala clinic, 200 SW 8th St., Suite A, open Monday to Friday, 9:00 AM to 5:00 PM.

Do I need my own blood pressure cuff for a telehealth phentermine visit?

No. You need a picture of a recent blood pressure reading, and it can come from a home monitor or a pharmacy blood pressure machine. Send it before your visit. Phentermine can raise blood pressure, so your provider needs a current number before deciding whether it's safe to prescribe.

Can I get a phentermine prescription on the free phone consultation?

No. The free consultation is a 15-minute phone call with the medical staff, for your questions. It is not a provider visit, and nothing is prescribed on the call. Phentermine is only prescribed after a visit with the provider, in person or by telehealth, and only if the provider decides it's right for you.

Can I take phentermine with weight-loss supplements I bought online?

Phentermine's FDA label recommends against combining it with other weight-loss products. It says the safety and effectiveness of those combinations have not been established, whether the other product is a prescription drug, an over-the-counter product or an herbal product. Tell your provider about everything you take at your visit, supplements included.

What is E-FORCSE, and does it apply to phentermine?

E-FORCSE is Florida's prescription drug monitoring program, and it covers phentermine. It collects dispensing records for Schedule II to V controlled substances, and phentermine is Schedule IV. With a few exceptions, Florida law requires prescribers to check a patient's dispensing history in it before prescribing a controlled substance to anyone 16 or older.

Will I see a doctor at a Padgett telehealth phentermine visit?

You'll see Sarah Weir, APRN, an advanced practice registered nurse. Dr. Jose Diaz, MD, is Padgett's Medical Director. Florida's telehealth law isn't limited to doctors. Its list of telehealth providers includes nurses licensed under chapter 464, and all of them are held to the same standard as in-person care.
